1. Introduction

Welcome to Agile Plan Management. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or using our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access our website or use our services.

2. Definitions

For the purposes of these Terms:

• "Service" refers to the NDIS plan management services provided by Agile Plan Management.
• "Website" refers to the Agile Plan Management website.
• "You" refers to the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.
• "NDIS" refers to the National Disability Insurance Scheme.
• "NDIA" refers to the National Disability Insurance Agency.

3. Service Description

Agile Plan Management provides NDIS plan management services to participants of the National Disability Insurance Scheme. Our services include:

• Invoice processing and provider payments
• Budget management and monitoring
• Monthly financial statements
• Claim lodgement and record-keeping
• Access to both registered and non-registered providers
• Participant reimbursements
• Financial-skills capacity building (if funded)

4. User Responsibilities

By using our services, you agree to:

• Provide accurate and complete information necessary for the provision of our services
• Maintain the confidentiality of any account information or login credentials
• Notify us immediately of any unauthorized use of your account or any other breach of security
• Not use our services for any illegal or unauthorized purpose
• Comply with all applicable laws and regulations

5. Service Fees

Our fees for plan management services are in accordance with the NDIS Price Guide and are claimed directly from your NDIS plan. We do not charge participants any out-of-pocket expenses for our core plan management services.

For participants with plan management funding in their NDIS plan, the NDIA will cover the cost of our services. If you do not have plan management funding in your NDIS plan, you may need to self-fund our services or request a plan review to include plan management funding.

6. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of information as described in our Privacy Policy.

7. Intellectual Property

The content on our website, including text, graphics, logos, images, and software, is the property of Agile Plan Management and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Agile Plan Management shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use our services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from our website
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our website

9. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

You may terminate your service agreement with us by providing notice in accordance with your service agreement. Termination will be subject to any notice periods and other requirements specified in your service agreement and applicable NDIS rules.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
